

The Delhi High Court has refused to grant bail to the accused husband in a sensational case, which has serious allegations like forcing his wife to ‘partner swapping’, offering her pictures on social media and offering sex in exchange for money and physical abuse. The court clarified that this is not a common marital dispute.
The court of Justice Girish Kathpalia dismissed the anticipatory bail plea of the accused husband on June 9, saying that the allegations made in the FIR are extremely serious and worrying, who do not fall under the category of traditional matrimonial disputes. The court made a detailed comment on aspects of sexual offenses, cruelty and cyber oppression with the woman.
‘Hands used to bite with blade, then …’, woman’s charge
The woman has alleged in the FIR that her husband used to torture her mentally and physically. He used to do domestic work forcibly by hurting the blade on his hand. Not only this, he used to force her to swapping partner and took her to the hotel once in this connection, where her friends molested the woman. Somehow the woman escaped from there and saved her honor.
‘Dewar too …’ woman told
The woman said that her brother -in -law also kept a wrong watch on her and sometimes touched inappropriately. When she complained to her husband, he tried to postpone it instead of taking it seriously and asked the woman to ignore it. The court termed it as a husband’s negligence towards the safety of the woman.
Fake profile made on Instagram
The victim has also alleged that her husband made her fake Instagram profile and put her personal pictures on her and posted a sex offer with her instead of money. The court, considering it as a ‘serious’, considered it as a cyber crime. The woman also told that the husband did this only to discredit her and mentally torture her.
The woman has not only accused her husband of rape, but has also made allegations of gang rape. He clearly explained in the statement before the magistrate, how he was made a victim of mental, physical and sexual harassment. The court said that despite such serious allegations, giving relief to the accused will be an agreement with justice.
Chat with fake name
The Delhi High Court also noted that the accused had bought a new SIM card and had a text chat with a woman named imaginary. However, it became clear in the investigation that the SIM is registered in the name of him. This proves that the accused deliberately contacted the woman and harassed her mentally.
