Questions raised on online betting and gaming, High Court formed a committee to UP government

The Allahabad High Court in an important order has directed the Uttar Pradesh government to set up a high -level committee, which will investigate whether online betting and gaming need to be regulated. The court has given this decision in view of the boundaries of the Public Gambling Act, 1867 and the requirements of the current digital age.

Questions raised on the relevance of gambling law

Justice Vinod Diwakar said, “The Gambling Act of 1867 is limited to the regulation of traditional sports such as cards such as cards and it is the law of the time of British rule. In today’s digital age, its effectiveness is under question.”

Committee will be formed

The High Court has directed the government to form a committee under the chairmanship of the state’s Economic Advisor KV Raju. In this, Principal Secretary (State Tax) should be included as a member, as well as the participation of subject experts in it is also said to be necessary. The order has been passed during the hearing of the petition of Imran Khan and another accused.

Accused of earning crores from online betting

According to the police, the accused were earning crores of rupees sitting at home through online betting. The High Court clarified that the Public Gambling Act is before the digital age, which has no mention of server, digital transactions or international operations. This law is limited to physical gambling houses, causing virtual gaming beyond its scope.

Danger of online gaming

The court said, “Online gaming platforms use psychologically designed reward systems and notifications, which increases the chances of addiction.” At the same time, the court also added, “Many of these platforms operate from abroad and their transactions are done through other means, which leads to difficulty in preventing law enforcement and financial fraud.”
