On behalf of the petitioner, the court was told that Amarnath Chaubey’s father Ram Bihari Choubey was shot dead on December 4, 2015. The petitioner’s brother Abhay Nath Choubey had lodged an FIR at the Chaubepur police station in Varanasi. Police arrested three accused Nagendra alias Raju Ajay Singh alias Ajay Maradah and Sunny Singh in this case. Nagendra alias Raju said in a statement that he carried out the murder at the behest of Ajay Singh.

Ajay Singh was in constant contact with local MLA Sushil Singh. Therefore, the police also started deliberations against MLA Sushil Singh, but the police did not deliberate properly due to his political reach and being associated with the ruling party. On this, the petitioner filed a petition in the High Court demanding a CBI Investigation. The High Court, while disposing of the petition, directed the CO level officer to investigate under the supervision of the Chief Secretary of the State Government. The petitioner then approached the Supreme Court. The Supreme Court (Supreme Court) entrusted Satyarth Anirudh Pankaj to investigate the case and after investigation asked him to submit the report.

In compliance with the order of the Supreme Court, the report of the investigating officer was sent to the trial court of Varanasi, where the trial is going on against other accused. The petitioner applied to the trial court to dismiss the conclusion of the investigating officer and summon the MLA as an accused. When the trial court rejected the application, this surveillance petition was filed.
